MD: Anti-Business Senate Overturns Veto, Attacks WalMart AGAIN
Maryland's Senate voted Thursday to enact a first-in-the-nation requirement that WalMart Stores Inc spend more on employee health care despite the governor's veto of the legislation. The measure, touted as a money-saver for Medicaid, now goes to the House for a vote.
At least 30 state legislatures are considering similar bills.
The Democratic-controlled Senate voted 30-17 to overturn a veto of the so-called WalMart bill last summer by Republican Gov. Robert Ehrlich. The measure now heads to the House, where the prospects of a three-fifths vote required to overturn vetoes was less certain, though Democrats control that chamber as well.

AFL-CIO President John J. Sweeney said Wednesday the legislation passed last week in Maryland to require employers to spend a percentage of their payrolls on employee health care was the "first crisp punch" in the fight for workers' rights.

A Maryland law requiring large, private companies doing business in the state -- especially Wal-Mart Stores, Inc. -- to spend at least 8 percent of their payroll on employee health benefits was overturned by a federal judge on Wednesday.
U.S. District Judge J. Frederick Motz in Baltimore ruled that the 1974 federal Employee Retirement Income Security Act (ERISA) trumped the Maryland Fair Share Health Care Act, which was passed by the Democratic-controlled state legislature in January, despite a veto attempt by Republican Gov. Robert Ehrlich, Jr.
