TN: Paedophile Teacher Pleads Not Guilty To 28 Charges


The lawyer for a former Warren County elementary teacher accused of having sex with a 13-year-old boy pleaded not guilty for his client Wednesday.

A 15th November trial date has been set for Pamela Rogers Turner, 27, who is charged with 15 counts of sexual battery by an authority figure and 13 counts of statutory rape, all involving the same boy.

Former Teacher Charged with Violating Probation via MySpace

The teacher who served six months in jail for having a sexual relationship with a student was arrested again.


Pamela Rogers was back in court Wednesday, charged with violating seven terms of her probation.

Prosecutors said Rogers wasn't allowed to use the Internet or have any contact with the victim's family.

Investigators believe Rogers broke both of those rules.

Rogers was released on bond Wednesday but will be back in court in July.

If Rogers is found guilty on these charges, she may have to serve more jail time.

Part of Roger's plea agreement ordered her not to use the Internet.

Authorities said Rogers established a Web site with several photos of herself.

Authorities said Rogers used a popular interactive Web site called Myspace.com to communicate with the victim's 17-year-old sister.

The court ordered her not to contact the victim or his family and to not use the Internet.

Under the profile, P.J. is a 28-year-old from Paris, France.

The 28-year-old convicted sex offender used a scantily clad picture of Britney Spears as a back ground on the popular interactive Web site.

You also heard music from Gwen Stefani.

She last logged on to the site Tuesday.

What may have concerned court officials was a message to a "Number 32."

The victim's aunt confirmed it's coincidentally the same jersey number worn by the 13-year-old she had an affair with when she was the child's teacher in Warren County.

An excerpt from a message to Number 32 read: “To Number 32: My plans are your plans. ... Nothing's changed. … Say it. ... Say it. … Always is the word. … Listen to ‘Far Away’ by Nickelback.”

On another part of the site, P.J. said she actually has brains and she's more than just another girl.

“I am not looking for a boyfriend. I am happily single, and I went through a divorce about a year ago, so I am not looking for anyone. I still believe in love, though. I just think that I will wait for about three years before I fall into that,” the site read.

The site also had a message for the media, where it said: “Southern slander suckz,” which seems to refer to a newspaper in Warren County.

“I mean, don't these people remember the story in the Bible about ‘letting the first one without sin cast the first stone?’” the site read.

It is possible that Pamela Rogers did not create this site.

There is no way to check the authenticity of the site.

There have been cases where someone has made a site using another person's name and pictures.

Rogers' attorney said his client is innocent.

The profile was taken down late Wednesday afternoon.

District Attorney Dale Potter, told the Tennessean Saturday April 15th he is considering pulling Rogers' phone records to see if she has been in contact with the teen.

Teacher plea deal built on sex bias
Prosecutor: Male jurors may not see sex with boy as crime

The district attorney who reached a plea settlement with ex-teacher Pamela Rogers for having sex with a 13-year-old student says one reason he didn't want to try the case was that some men on a jury would not convict an attractive woman for having sex with a teenage boy.

District Attorney General Dale Potter said he was concerned that some male jurors might not convict Rogers, a former Warren County grade-school physical education teacher, because they wouldn't view what the attractive 28-year-old woman did as having harmed the boy.

"The fact that I could not get a jury of all women did play a heavy factor in my decision not to go to trial," Potter said.

"There's a segment of men that would say that the victim wasn't harmed, but instead got lucky ... . You can have a horrible case, but if it appeals to that jury it can be difficult."

The societal double standard and the fact that the family of the boy preferred not to have to go through a trial were the two main factors in his decision to settle the case, Potter said.

Rogers pleaded no contest in August to four counts of sexual battery by an authority figure, served about six months in a county jail, and was released early for good behavior in February.

Now, less than two months after her release, Rogers finds herself back in trouble on allegations of violating the terms of her probation.

And Potter is facing another round of second-guessing for not taking Rogers to trial. He said he remains convinced the decision was the right one.

The double standard on such sex-offense cases exists nationally for a number of reasons, said David Raybin, a defense attorney and former prosecutor.

Male victims tend to be more embarrassed about coming forward and testifying in such cases. Also, some jurors would consider an adult male having an affair with a girl as much more harmful than a woman having sex with a boy.

"Absolutely, there is a significant disparity of treatment in the way the criminal justice system handles these things," Raybin said. "Unfortunately, there's a double standard because there is a double standard in society."

Potter said another factor, although a lesser one, in his decision to avoid a trial last year was what he said would have been a "media circus" that could also have affected the outcome of a trial. The case has drawn national attention, with photos of the attractive blonde ex-teacher broadcast on television and posted on Internet Web sites.

Under the plea agreement, Rogers was allowed to avoid prison and instead serve nine months in the Warren County Jail, with the remainder of the eight-year sentence as probation.

But her probation came with a number of conditions, including not using the Internet without permission and not having any contact with the boy or his family. Violating those rules could send her to prison to serve out her sentence.

Rogers was arrested last Tuesday on seven counts of probation violations, all of them centering on her use of the Internet. She is accused of setting up a personal Web page and using it to post messages to the boy. She also had Internet communication with the boy's teenage sister, authorities say.

And authorities are investigating whether Rogers tried to make contact that would have violated her probation by other means, perhaps by telephone. Potter would not say whom the contact may have been with, but said he is not surprised Rogers is in trouble again.

"We were taking a chance she would mess up. Every time you put someone on probation, you do it with the idea that there's a good chance they will."

Potter said he sought the maximum probation period last year and will ask a judge at a July hearing to have Rogers serve out her sentence in a state prison.

Rogers' attorney Peter Strianse said last week he is "very concerned" about the charges against his client.

"The state has a much lower burden of proof to establish a probation violation. The consequences for a probation violation could be grave."

He added said it was too early to comment about specific charges.

Phone logs sought in Rogers case
Possible contact with boy beyond Web investigated

The former Warren County teacher at the center of a student sex scandal may have had "additional contact by phone" beyond her attempts to contact the boy via the Internet, a prosecutor said.

District Attorney General Dale Potter said he would consider reviewing phone records in the case of Pamela Rogers, 28, but would give few other details, such as whose records were involved.

"We're exploring the option that there may have been additional contact by phone," Potter said. "At this point, I don't want to say with who. We'll be looking at various phone records."

Rogers was convicted last year of having sex with a 13-year-old boy, a former student, and was released from jail in February. The former Centertown Elementary gym teacher was arrested again this week on charges that she violated probation by posting messages to the victim on her personal page on the Web site MySpace.com and had contact through the Web site with the boy's teenage sister.

The charges lodged against her Tuesday include seven probation violations centered on her use of the Internet. Her probation conditions prohibited her from having any contact with the boy or his family and prohibited her use of the Internet without permission from her probation officer.

A judge will decide at a July hearing whether Rogers should be sent to prison for the remainder of the eight years she was to have served on probation. Until that hearing, she is free from the Warren County jail after posting $10,000 bond.

"As the judge said (this week): 'This lady had a college education; she can read and write; she knew what the rules were,' " Potter said.

A warrant executed Tuesday said Rogers contacted the boy's teenage sister through MySpace.com, a youth-oriented social networking site; that she posted Internet messages meant to reach her victim; and that she has sent more than 100 e-mails and received more than 200 through her Web account.

In her MySpace postings, she addressed the boy by his basketball jersey number, court records said, referred to him as her "hero," and said she would wait three years before falling in love — an age at which the victim will have reached the legal age of sexual consent, Potter said.

She also posted photos of herself in a bikini. The site was taken down Wednesday.

The case made international news last year. The victim was a star athlete. Rogers was accused of having intercourse or oral sex several times with the boy, including at least once at the school.

She pleaded no contest in August to four counts of sexual battery by an authority figure and was sentenced to serve nine months in the county jail with the remainder of her eight-year sentence served on probation. The daughter of a prominent high school basketball coach from Fentress County, she was also required to give up her teaching certificate for life.

She was let out early for good behavior and was released from jail on Feb. 26. The MySpace site was set up late last month, the warrant said.

Her attorney Peter Strianse said that Potter has told him that he plans to subpoena phone records in the case. Potter would not say if the review of phone records would be through subpoena but said, "that would definitely be something to be considered."

The prosecutor said he will provide additional evidence in the hearing that is not mentioned in the warrant, but he would not elaborate yesterday.

Strianse's strategy since he took the case last year has been to keep his client out of the state prison system and to avoid "the vagaries of the parole system." He said the plea agreement reached in August gave her a defined sentence of less than a year in the county jail and allowed her to have some measure of control in getting her life back in order.

"That's all in jeopardy," Strianse said yesterday, adding that he is concerned about what may lie ahead for his client.

Strianse said he is not surprised that Potter will seek to have his client serve out her sentence in the prison system.

"I know he's running for re-election," Strianse said. "I would expect him to say that."
